The Politeian Nomos

Preamble

We, the citizens of the Meritocratic Isles, who have given rise to the powerful, who have been lost to obscurity, and who have witnessed the fall of more than one Meritocratic government, have determined to solidify a new bond of Meritocracy in order that we may protect our freedom, sovereignty, and common heritage from atrophy and assault, and that we may govern through the excellence and expertise of ourselves and our fellow citizens, do hereby establish this constitution of the Meritocratic Isles, and shall henceforth be known as the Politeia.

Article I: Prefectural Status

1. The Meritocratic Isles, under the governance of the Politeia, shall be a Prefecture of The Meritocracy and shall be governed in accordance with the Treaty of Reunification and the Meritocratic Accords.

2. The Politeia shall recognize the jurisdiction of all courts operated by the Meritocratic Senate.

3. The Politeia shall govern all aspects of regional policy not delegated to the Meritocratic Senate, nor prohibited to the Meritocratic Isles, by the Treaty of Reunification and the Meritocratic Accords.

4. Should the Meritocratic Isles no longer stand as a Prefecture of The Meritocracy, all clauses herein shall remain intact with the exception of those clauses that grant authority to The Meritocracy and its institutions.

Article II: Citizenship

5. Nations residing within the Meritocratic Isles shall have the right to apply for citizenship within the Politeia.

6. Every citizen shall serve in the Apella and shall be permitted to vote freely without fear of coercion.

7. The Politeia shall not infringe upon the national sovereignty of its citizens except under the direst of circumstances.

8. Citizenship within the Politeia is voluntary and may be renounced at any time.

Article III: The Apella

9. The Politeia shall be governed in accordance with legislation approved by an assembly of all citizens in good standing, who shall together constitute the Apella.

10. Every citizen shall possess an equal vote in the Apella.

11. The Apella shall have power, by and with the consent of the Gerousia, to pass legislation.

12. The Apella shall have power to approve treaties for ratification by the Archon Basileus.

13. The Apella shall have power to screen applicants, set forth rules of entry, and grant citizenship.

14. The Apella shall have power to elect the Archon Basileus and the Ephors.

15. The Apella shall have power to confirm the Archon Praefectus upon his appointment and upon every second month of his term.

16. The Apella shall have power to confirm appointments made by the Archon Basileus.

17. The Apella shall have power to call votes of no confidence against the Archon Basileus and the Ephors.

18. The Apella shall have power to call votes of expulsion against citizens.

Article IV: The Gerousia

19. The Politeia shall be administrated by the Gerousia, who shall enact the policies of the Archon Basileus and approve legislation passed by the Apella.

20. The Gerousia shall be composed of Gerontes who shall together number no fewer than four and no greater than 1/5 of the Apella.  This cap shall be ignored while the Apella is composed of fewer than twenty citizens.  The Gerontes shall come to power in three ways:

21. The Archon Basileus and the Archon Praefectus shall be entitled to serve in the Gerousia for the duration of their terms of office.

22. Upon completing a term of office, the Archon Basileus shall, with the consent of the Apella, be made into a permanent member of the Gerousia to serve so long as he retains his citizenship. 

23. The Archon Basileus, by and with the advice and consent of the Apella, shall appoint Gerontes to the Gerousia who shall serve at the pleasure of the Archon Basileus.

24. The Gerousia shall have power, by and with the consent of the Apella, to approve legislation.

25. The Gerousia shall have power to execute the laws of the Politeia and the policies of the Archon Basileus.

Article V: The Archons

Section 1 – Archon Basileus

26. The Politeia shall be headed by an Archon Basileus who shall act as the Head of State, the Head of Government, and the Commander-in-Chief of the militia.

27. The Archon Basileus shall have power, by and with the advice and consent of the Apella, to enter the Politeia into agreements with foreign organizations.

28. The Archon Basileus shall have power to promote soldiers and to appoint Junior and Senior Officers of the militia.

29. The Archon Basileus shall have power, by and with the advice and consent of the Apella, to appoint Gerontes, General Officers and Field Marshals of the militia, Ambassadors, and all other officers of the Politeia whose appointments are not herein otherwise provided for.

Section 2 – Archon Praefectus

30. The Politeia shall host a representative of The Meritocracy who shall hold the office of Archon Praefectus.

31. The Archon Praefectus shall be responsible for intercommunication between The Meritocracy and the Politeia, especially on matters of foreign policy and the military.

32. In the event that the office of Archon Basileus is vacant, the Archon Praefectus shall assume the duties of the Archon Basileus until a new Archon Basileus can be elected.

33. The Senate of The Meritocracy shall have power to appoint a member from within its ranks to serve as Archon Praefectus with the following stipulations:

34. The Archon Praefectus shall be a dual citizen of the Politeia and the Meritocratic Senate and shall maintain good standing within both bodies. The appointee for Archon Praefectus shall also be confirmed by a majority vote of the Apella before taking office.

Article VI: The Ephors

35. The Politeia shall be overseen by the Ephors who shall ensure the laws of the Politeia are upheld.

36. The number Ephors shall always be odd and shall never exceed five.

37. Should the number of Ephors ever be even, the Ephor last granted citizenship shall be removed from office, and the Apella may choose to hold new elections.

38. The Ephors shall maintain the Court of the Meritocratic Isles, in which shall be vested the power to arbitrate disputes among citizens and to prosecute crimes as defined by the legal code of the Politeia.

39. The Ephors shall have power to investigate accusations of wrongdoing and shall have power to bring charges against citizens in the Court of the Meritocratic Isles.

40. The Ephors shall have power, by 4/5 supermajority vote, to strike down legislation not in accordance with the Treaty of Reunification or the provisions herein.

41. The Ephors shall have power, by majority vote, to demote officers of the militia for disobedience and dishonorable conduct.

42. The Ephors shall have power, by majority vote, to arbitrate disputes concerning the interpretation of law.

43. The Ephors shall have power, by majority vote, to extradite accused criminals to the Meritocratic Court if it is proven that the alleged crime was committed under the jurisdiction of the Meritocratic Court and if there is a reasonable case against the accused.

44. No Ephor shall serve as an Archon or a Geronta.  Should an Ephor be a permanent member of the Gerousia due to a previous term as Archon Basileus, the Ephor shall temporarily give up the powers he possesses as a Geronta.

Article VII: Legislation

45. Legislation shall go into effect after it has been passed in both the Apella and Gerousia, and is not immediately challenged by the Ephors.

46. If passed legislation is immediately challenged by the Ephors, it shall not go into effect until such time as it is approved by that body.  Should the Ephors fail to resolve the challenge in ten days, the legislation shall go into effect despite the challenge.

47. Legislation shall be statutory law, secondary to this constitution and the Treaty of Reunification.

48. Legislation shall overrule legal precedent.

Article VIII: Voting

Section 1 – Normal Voting

49. All voting within the Politeia, unless otherwise noted, shall span a period of time no less than three days and no more than seven days.

50. All normal voting shall be decided by a simple majority.

51. Should an absolute majority of the electorate vote in the affirmative for a proposal, the voting may be ended early, with the exception of elections for Archon Basileus and Ephor, votes of expulsion, amendments to this constitution, and all special polls requiring more than a simple majority.

Section 2 – Election for Archon Basileus

52. The Archon Basileus shall be a citizen in good standing elected by the Apella as follows:

53. On the twentieth day of every even-numbered month, the Apella shall call for nominations for Archon Basileus.  During this process, no citizen may give his support to more than one candidate.

54. Those citizens receiving a nomination and a second by the end of the month shall be placed on the ballot. 

55. An election shall begin on the first day of every odd-numbered month and shall continue for four days. 

56. The votes shall be counted, and the result may be challenged on the fifth day. 

57. If a candidate receives a majority of the votes cast and there is no challenge, he shall take the office of Archon Basileus on the sixth day. 

58. If no candidate receives a majority of the votes cast, a runoff election shall be held between the two candidates with the highest number of votes. 

59. All challenges shall be arbitrated by the Ephors. 

60. In the event that two candidates receive exactly half the vote, the Ephors shall elect the Archon Basileus.

Section 3 – Election for Ephor

61. The Ephors shall be citizens in good standing elected by the Apella as follows:

62. On the twentieth day of every odd-numbered month, the Apella shall call for nominations for Ephor.  During this process, no citizen may give his support to more than one candidate.

63. Those citizens receiving a nomination and a second by the end of the month shall be put before the Apella for a vote of confirmation.

64. The confirmation votes shall begin on the first day of every even-numbered month and shall continue for four days. 

65. All candidates shall appear on separate ballots, and each ballot shall have the option to confirm or deny the candidate.

66. The votes shall be counted, and the result may be challenged on the fifth day.

67. All candidates receiving a simple majority in favor of confirmation shall be ranked according to the number of affirmative votes received, from most to least, and the highest ranked candidates—who shall number the greater of one, three, or five—shall take office on the sixth day.

68. Should a tie prevent an odd number of Ephors from taking office, a runoff election shall be held between the candidates with the tied votes.

69. All challenges shall be arbitrated by the Gerousia. 

70.  Ephors shall serve a two month term, and they shall only retain their office if reconfirmed by the process outlined herein.

Section 4 – Vote of No Confidence

71. An Ephor or an Archon may be removed from office by a vote of the Apella as follows:

72. A petition of citizens numbering 1/5 of the Apella shall be collected and presented to the Apella.

73. After the acquired signatures are obtained, a vote of no confidence shall be held in the Apella.

74. The poll shall remain open for no fewer than three days and no more than seven.

75. Should a 2/3 supermajority of the voting citizens express a lack of confidence, the official must resign from office.

Section 5 – Vote of Expulsion

76. A citizen may be expelled from the Politeia by a vote of the Apella as follows:

77. A petition of citizens numbering 1/5 of the Apella shall be collected and presented to the Ephors

78. After the acquired signatures are obtained, a vote of expulsion shall be held in the Apella.

79. The poll shall remain open for no fewer than three days and no more than seven.

80.  Should a 2/3 supermajority of the voting citizens approve the vote of expulsion, the citizen shall be expelled from the Politeia.

Article VII: Amendment and Ratification

81. This constitution shall only be amended by a 2/3 vote of the Apella.

82. We, the undersigned signatory parties do hereby agree to the provisions of this constitution, in its current form and in any future form it may take, so long as it is amended in accordance with the provisions herein.




Amendment I:

83. Should the office of Archon Basileus be vacated, the Apella shall call for new nominations and elections as soon as possible. 

84. There shall be four days allotted to nominations, followed by an election that shall span four days. The results may be challenged on the day after the election. 

85. If there are no challenges, the new Archon Basileus shall serve the remainder of the current term.

86. All anomalies during the election shall be handled according to Article VIII, Section 2. 

87. The subsequent election for Archon Basileus shall follow the schedule outlined in Article VIII, Section 2.

September 17, 2006:  Amendmentment I was passed.
